The Mount Vernon Board of Estimate and Contract voted Tuesday to pay a $75,000 settlement to Jose Fonseca to end his police misconduct lawsuit against the city and its police department.
Fonseca of Mount Vernon sued the city in 2013, alleging that he was unlawfully arrested on Dec. 4, 2012. In court papers filed with the state Supreme Court, Fonseca claimed all the charges against him were subsequently dropped.
“I did not commit the crimes I was charged with and I did not resist arrest,” Fonseca wrote in his filings. “The officer did not have a right to hit me so many times under any circumstances.”
